Terms & Conditions
For the purposes of this and future agreements, the term “The Recording Studio” refers to “GoldBerry Records” located at 548 South Spring Street, Suite #508, Los Angeles, CA 90013. The term “Costumer” refers to the person or company named on the booking message, invoice or Recording Studio Rental Agreement.
BOOKING
The “Costumer” agrees to pay a deposit of 50% before Recording time at the rate or promotions in which the “Costumer” and “The Recording Studio” agreed to. The specified non-refundable deposit is to lock in the Studio booking time. The deposit will be applied to your session or refunded if you cancel more than 48 hours before your session time. If your deposit is not received within 48 hours of your session time, your time may be forfeited to another “Costumer”. Rates are subject to change. In the event of cancellation or rescheduling of a booking within less than 48-hour notice, the “Costumer” agrees to forfeit the deposit placed to hold the booked session time. Minimum session time is three (3) hours for Studio rental with sound engineer.
PAYMENT
Payment is required prior to each session. Payments can be made by cash, Zelle, PayPal, Venmo, Samsung Pay or Apple pay. Any additional charges incurred must be paid prior to the recording session. The “Costumer” is responsible for any and all legal costs and attorney’s fees required to collect payment for any services rendered.
STARTING TIME
Appointment times have been arranged specifically for the “Costumer”. If the “Costumer” arrives late for a scheduled session. The end time session stays the same even if the Client is late for his/her session. If the “Costumer” is late in excess of 30 minutes, the Recording Studio reserves the right to cancel the session and the “Costumer” forfeits all deposits.
ENDING TIME
If the “Costumer” should require a little more time, the Recording Studio will try to continue and ask the next scheduled appointment if they can wait. However, if this is not acceptable to them, the Recording Studio will ask that you be considerate and stop your project and schedule another session. All Recording Studio time extension requests are contingent upon Recording Studio availability and must be paid upon approval. If the original session was booked through a promotion, the extended time will be charged at the regular Recording Studio rate at the time of the session. If the “Costumer” chooses to end the session early, the “Costumer” will still be responsible for payment for the entire time in which they have reserved. The “Costumer” will not be entitled to a refund or credit if they choose not to utilize the time reserved in its entirety.
CANCELLATIONS
If the Recording Studio is required to cancel a session due to unavoidable circumstances not within the Studio’s control such as natural disasters, engineer sickness, and technical difficulties, the Recording Studio will reschedule the session for the earliest available time consistent with the needs of the “Costumer”. In the event that neither the “Costumer” nor the Recording Studio can reach an agreement on a date and time for re-schedule, the Recording Studio shall refund the full deposit amount to the “Costumer”.
FINAL PRODUCTS
The Recording Studio will not issue a refund AFTER a recording session has been performed and/or MP3 or WAV files have been delivered to the “Costumer”. We make every effort in working with the “Costumer” to deliver the highest quality product per the “Costumer’s” expectations. The Recording Studio shall not transfer recording files or copies thereof to the “Costumer” or “Costumer’s” representative until all outstanding balances are paid in full. Until such time as the “Costumer” has met the monetary terms of the Recording Studio’s rental agreement, all recording files will be left at the Recording Studio. When the “Costumer” has successfully fulfilled their monetary obligation to the full satisfaction of the agreement, the Recording Studio will release the recording files to the “Costumer”. Any and all material protected by copyright shall remain the property of the copyright holder.
The Recording Studio will NOT backup the “Costumer’s” recording files. All session files shall be released to the “Costumer” or “Costumer’s” representative at the end of the recording session. It is the “Costumer’s” responsibility to provide a personal flash/hard drive to the Recording Studio for the purpose of downloading/releasing the recording files to the “Costumer” in their entirety. Alternatively, the Recording Studio may transfer all recording files to the “Costumer” by attaching a link containing the files and sending to the “Costumer’s” email address of record. Any such link will be valid and accessible to the “Costumer’s” for a period of seven (7) days. On the eighth (8th) day, all files will be permanently deleted unless the “Costumer” has made other arrangements with the Recording Studio in advance.
COPYRIGHT
The “Costumer” hereby claims sole responsibility for obtaining any and all licenses needed before duplication or replication of any works in which the “Costumer” does not lawfully own the rights to. It would be in the “Costumer’s” best interest to assign ISRC codes for each recorded track, which should be embedded in the digital media when the master is produced. The “Costumer” also assumes full responsibility for any and all fees associated with obtaining such licenses and codes. These rules apply to all individuals. There are absolutely no exceptions whatsoever.
The “Costumer” affirms that he/she is the rightful owner or assignee of material to be recorded or reproduced. “GoldBerry Records” and our employees are not responsible for copyright violations, talent, or creative royalties, mechanical reproduction licenses, or any other liabilities for such material.
FOOD AND BEVERAGE
The lounge is available for your convenience at no additional charge. The lounge has a kitchen with microwave and refrigerator/freezer, dining table, and a private restroom. The “Costumer” may bring his/her own food and beverages and store them in the refrigerator, or may order food to be delivered. Food and drinks are not allowed in the Recording Studio at any time and must be kept away.
TRASH
Please be considerate and dispose of trash accordingly. You are expected to clean up all the mess you make. The “Costumer” also agrees to pay to the Recording Studio all fees necessary to return the Recording Studio to the pre-rental condition should the Studio be left unclean or in any type of disrepair. The “Costumer” will be charged a cleaning fee.
NO SMOKING
Smoking is prohibited anywhere inside the building complex and is not permitted in the Recording Studio at any time before, during, or after a recording session. This includes, but not limited too hookah, cigarettes, marijuana, vape pens, ecigs, etcs. If the “Costumer” leaves the premises to smoke, please ensure that you are a safe distance from the Recording Studio and that your cigarette stubs are disposed of appropriately. If the “Costumer” or any member of their party is in violation with this agreement, then the session will be cancelled, and all payments will be forfeited.
PERSONAL ITEMS
The “Costumer” shall maintain sole responsibility for all personal items brought to the Recording Studio. The Recording Studio itself holds no liability for any of the “Costumer’s” personal property that is lost or stolen while on Studio grounds.
DAMAGES
In the event a piece of Studio equipment owned by “GoldBerry Records” or any part of its facility becomes damaged by the “Costumer”, or anyone in your party, due to negligence, accident, or willful act, the “Costumer” agrees to provide monetary compensation in the amount of full replacement value of the damaged item. Damage to the Recording Studio property of any kind that are a result of anyone in the “Costumer’s” party or group will be assessed to the “Costumer’s” account. When leaving and entering the complex, please remember that the entry door must be kept shut and locked at all times. Any theft or damages that occur as a result of the door being left open will be chargeable to the “Costumer”. The “Costumer” hereby releases the Recording Studio and Recording Studio’s employees from any liability for harm or damage that may occur to property, equipment, or persons in “Costumer’s” party while on Studio grounds.
DRUGS ARE STRICTLY PROHIBITED
We reserve the right to deny access to our premises and our equipment to those clearly under the influence of drugs or alcohol.
MINORS IN THE STUDIO
Minors (under 18) must be accompanied by an adult at all times, and have a signed waiver (provided by Studio) that is signed by the minor’s parent(s) or legal guardian. Emergency contact information must be provided by the parent or legal guardian.
NO PETS
There is a strict No Animal Policy for “GoldBerry Records” except for licensed service animals. Service animals must be verified by an “GoldBerry Records” Staff member. “Costumer” agree to disclose any service animals brought into the Recording Studio. The “Costumer” agrees to pay for and repair any damage caused by the animal in both the Recording Studio and the building. The “Costumer” agrees to cover the cost of injuries caused by the pet while on the Recording Studio property. “Costumer” is responsible for ensuring the pet is not a public nuisance or disturbance.
PARKING
There is plenty of street parking outside the building. “Costumer” agrees to use street parking. “GoldBerry Records” assumes no liability or responsibility for loss, damage or theft to any vehicle or its contents.
STUDIO INTERNET SERVICES
Recording Studio does provide high speed internet access for use. Please consult the internet usage terms below, as they are as follows.
PROMOTION
The “Costumer” hereby agrees that the Recording Studio, under its own discretion, may use their photos, voice, works, name or likeness for purposes of promoting the Recording Studio. This will be done through Social Media, Blog, news and any other appropriate platform where a “Costumer’s” talent will be showcased for the benefit of the Recording Studio. The Recording Studio upholds in high regard the privacy of the “Costumer”.
For this reason, the Recording Studio will never sell, share or download the “Costumer’s” recordings without prior written consent from the “Costumer”.
RESPONSIBILITY
The “Costumer” agrees to furnish a written signed copy of the above Studio policies as a formal agreement, obligation to make payments, and adhere to all other policy requirements as stated herein. The “Costumer” is responsible for the actions of all artists and guests he or she brings to any session.
